How long do I have to appeal a denied workers’ comp claim?

If your California workers’ comp claim is denied, you generally have 20 days from the date you receive the denial letter to file an Application for Adjudication of Claim with the Workers’ Compensation Appeals Board (WCAB).

From there, you can request a hearing before a judge—sometimes called a "mandatory settlement conference"—to present your case. It’s important to act quickly, because missing deadlines can mean losing your right to appeal.

You’ll want to gather:

  • Medical records
  • A copy of the denial letter
  • Any communication from your employer or insurer
  • Documentation of your injury and treatment

Appeals can be complex, and insurance companies often use technicalities to avoid paying. We can help you build a strong appeal and represent you in front of the WCAB.
